ARRIVAL AND DEPARTURES
Check In from 2 p.m.
Check Out at 10 a.m. Should you require a late check out please request as early as possible this and we will do our best to accommodate you (subject to availability as cleaners are booked to arrive at 10am). Please be aware that if you do not check out by 10am a late check out fee of $75.00 per hour until midday and a full day’s rent thereafter will be charged.
Please ensure all garbage is in the red bin & all recycling in the yellow bin – stored at the top of the driveway.
It is expected that the property is tidy before leaving, i.e. ‘leave it as you found it’ with all furniture in place.
SeaSpray has a NO PARTY rule for all bookings. And please, no loud noise after 11pm. We are fond of our neighbours and Broken Head is a place renown for its tranquility – regular family mayhem is of course acceptable.
SeaSpray reserves the right to cancel any booking due to owner/operator error and refund all reservation fees.
•A Security Bond of $1000 is held to account for any missing or damaged items, excessive noise leading to complaints and general cleanliness of the property, e.g. deductions for extra cleaning if the property is not left in a clean & tidy condition, washing up done, BBQ cleaned (separate $60 fee) and rubbish removed etc, (see: Conditions of the property).
•Any damage or loss to the property, building, contents and surrounds will be assessed and the appropriate fees to return the damage to pre-guest condition will be deducted from the security bond.
•Should the damage or loss of contents be greater than the bond amount, the guest agrees to pay the difference within 7 working days.
•A compendium list of all items and replacement cost is available for guests at SeaSpray on request.
•Should any changes to the booking be required, please contact SeaSpray immediately. We will endeavor to accommodate any changes, however if we cannot and the guest wishes to cancel the booking then the usual cancellation fees apply.
•A cancellation does not constitute a change, please refer to cancellation policy.
•Changes which must be notified in advance to SeaSpray include: Increase in number of guests; requests for change of dates; change in composition of guests. e.g. couples to all men, adults to teenagers etc.
•SeaSpray retains the right to refuse or cancel a booking if any change is not agreed upon.
SeaSpray strongly advises all guests to take out their own travel insurance in the event you have to cancel your booking or for any unforeseen events that may impact upon your time away.
LICENCE NOT A TENANCY
This is not a residential tenancy agreement under the NSW Residential Tenancy legislation.
Failure to comply with any of the Guest’s fundamental obligations and the terms and conditions of the property may result in immediate termination and eviction.
Refunds will not be paid on terminated occupancies.
As a duty of care to our property we reserve the right to refuse any bookings that we feel may be inappropriate.
NUMBER OF GUESTS
The number of occupants must not exceed the number shown on your booking confirmation. Any additional occupants will be requested to leave the property and a deduction may be may made on the security deposit.
The Owner and Manager of the property do not condone unsafe, unruly, irresponsible or illegal conduct/behavior on the premises during your stay. The Owner and Manager accept no responsibility for any actions, incidents, loss, damage or injury sustained during your stay at the premises. The Guest accepts and agrees that a condition of the stay and use of facilities at the property is that all guests indemnify and agree to keep indemnified the Owner and Manager against all liability whatsoever and howsoever arising including but not limited to any actions, incidents, loss or injury sustained during their stay at the property.
RESPONSIBILITY & LIABILITY
SeaSpray both for itself and on the behalf of the owners, managers, employees and contractors, does not accept any responsibility for any act, omission, default or neglect of themselves, their managers, employees and contractors for injury, damage, or loss to persons or goods whatsoever or however the same may be caused and they do not warrant and are in no way responsible for the accuracy of any information given in statement made by their service providers in terms of travel arrangements. By utilising the services provided by SeaSpray you agree that:
SeaSpray shall not be liable for the willful or negligent acts and/or omissions of such carriers and/or service providers. SeaSpray and it’s owners, managers, employees and contractors will not be liable for any accident, injury, delay, property damage or personal loss to you or those traveling with you in connection with any accommodation, transportation, any defect or faulty facility or service offered or other travel services resulting directly or indirectly from any occurrences or conditions beyond its control, including but not limited to acts of terrorism, act of God, defects in vehicles, war, strikes, theft, delay, cancellation, civil disorder, disaster, Government regulations or changes in itinerary or schedule.
Please note that all travel documents, observance of laws and regulations of various Governments are your responsibility.
SeaSpray has taken due care to ensure all information displayed is accurate, however as information is collected from a large number of sources, we cannot guarantee that all information is free from errors. All bookings are made with this understanding that SeaSpray cannot be responsible for errors or resultant guest misunderstanding of property information and other information offered.
NOISE AND HOTLINE
No excess noise from Stereos, TV’s, DVD’s or any other equipment, loud voices, noisy pets etc. is to be made, particularly after 11 pm at night. For the comfort of other guests and neighbours, minimal noise only to be audible outside of the property at any time. SeaSpray is a member of the Holiday Letting Organisation (HLO) who have a noisy neighbour contact number. Guests will be charged $250 for the first call out which will be taken from the security deposit. A second call will be charged at $500. If HLO and/or the police, managers or security are called or your group is warned for noise or anti-social behaviour more than once during your entire stay, your bond may be forfeited and you can be evicted without refund.
Please note Broken Head is a nature reserve so no animals are allowed on the beach. There is a dog walking beach at Suffolk Park. If you have an animal that you would like to bring, we may be able to help if they are able to stay outside. You will need to speak directly with us to arrange this. Please note, the gated area in the back is quite small and we cannot guarantee your pet won’t escape. One pet only is allowed and only if agreed to at time of booking and at the discretion of management. Bringing your pet is entirely at your own risk.
Smoking is not permitted within the house under any circumstances. Ashtrays are provided for those who wish to smoke outside. Any evidence of smoking in doors will result in the full security bond being forfeited.
SeaSpray accepts no responsibility for the personal property of guests so please take care.
All guest are provided with linen including – 1 x Bath towel and 1 x beach towel for the duration of your stay. For those who are our guests for two weeks or more, a linen changeover is provided including all towels, sheets etc.
Missing linen/ blankets/ pillows/towels and duvets etc will be charged as per the compendium price should any go missing.
Seaspray has a garage to fit 2 normal sized vehicles. N.B. the clearance height is 2.2 metres and any SUV, vans or larger vehicles may not fit or reduce the capacity of the garage. The driveway can accommodate 2 vehicles max. Please do not park on the grassed areas. There is street parking opposite Seaspray adjacent to the entrance to the Pavilions. SeaSpray accepts no responsibility for any damage to any vehicles either on site or whilst traveling to or whilst guests are staying at SeaSpray.
CONDITIONS OF THE PROPERTY
Please remember this is our family beach house and we ask that you respect it and our neighbours.
•The property is to be fully secured when unattended
•Upon vacation: all rubbish is to be placed in the bins provided, dishes washed and put away, furniture in original position, excess dirt swept, rubbish removed from gardens, BBQ cleaned.
•All damages, breakages or losses to the property furniture or furnishings will be paid for by the guest. Loss of keys will attract a $400 fee to cover the change of locks.
•Absolutely NO SMOKING inside the property. Loss of the entire bond will result.
•Breaches of these conditions may result in the forfeiture of your SECURITY BOND, refusal of key and/eviction at the discretion of the management. If you are evicted prior to your departure date the balance of your accommodation is NOT SUBJECT TO REFUND.
